Michael Planell

Mike Planell is a partner in the Firm’s Litigation Department.  Mike concentrates his practice on complex business and commercial disputes in courts located in New York and around the country.  Mike’s recent experience includes:

 

  • Serving as trial counsel (second chair) for the respondent in a proceeding in New York state court where the claimant sought an award in excess of $100 million based on the contention that a constructive trust should be imposed over proceeds the respondent received from the sale of his stock in a publicly traded company;

 

  • Serving as trial counsel (second chair) for the plaintiff and counter-defendant in a dispute relating to the sale of two apartment complexes in Virginia;

 

  • Successfully briefing and arguing a motion to dismiss claims brought in Florida state court seeking in excess of $200 million based on allegations that a bank assisted a fraud perpetrated by one of its customers; and

 

  • Successfully briefing and arguing an appeal in New York’s Appellate Division, Second Department which resulted in a decision vacating a money judgment issued against the defendant in a dispute relating to a commercial lease.
     

Mike has litigated a wide variety of matters involving breach of contract, business torts, fraud, breach of fiduciary duty, partnership and shareholder disputes, product liability, employment disputes, unfair competition, civil RICO claims and real estate disputes (including specific performance actions, construction litigation, landlord/tenant disputes, foreclosure actions and partition actions).  Mike also has significant experience in arbitration (including before AAA and JAMS), as well as in mediation and other forms of alternative dispute resolution. 

 

Prior to joining the Firm, Mike was associated with two international law firms, where he represented clients in a broad array of commercial, class action, and product liability litigation.   

 

Mike graduated cum laude from Fordham Law School in 2003, where he was a member of the Fordham Law Review and the Order of the Coif.  He also received a Dean’s Merit Scholarship, the Fordham Law School Prize, and the Hugh R. Jones Award.  Mike obtained his undergraduate degree with honors from Loyola College in Maryland.

 

Mike is admitted to practice in New York State, as well as the United States District Courts for the Southern, Eastern and Western Districts of New York.
