Anthony P. DeCapua is a partner in the firm’s construction and litigation practice groups. 

 

Anthony concentrates his practice on the representation of property developers, owners, real-estate management organizations, architects, engineers, general contractors, subcontractors, material suppliers, and sureties in all facets of private and public sector construction both as an advisor and advocate.

 

Anthony negotiates and drafts all types of construction related contracts including AIA and inhouse forms.  Anthony also negotiates and drafts site access/protection agreements on behalf of owners and general contractors.  He guides clients during projects with regards to contract administration and claim preservation.  Anthony consults on construction risk exposure, project insurance coverages, project bonding requirements and mechanic’s liens.  When there is a need Anthony can assess indemnitor liability and negotiate surety workout agreements.

 

Anthony has extensive experience litigating construction and commercial disputes in both state and federal court.  Anthony also represents clients in alternate dispute resolution proceedings including mediation and arbitration before the American Arbitration Association and JAMS.  In construction cases Anthony has represented general contractors and trade specific companies in breach of contract matters, payment and performance bond claims, mechanic’s lien claims, extra work disputes, delay claims, construction defect cases, bid disputes,  RPAPL 881 proceedings and trust fund diversion actions.

 

Anthony is a graduate of St. John’s University and received his J.D. from Touro College Jacob D. Fuchsberg Law Center.  He served as a judicial intern to the Honorable F. Dana Winslow, New York State Supreme Court.

 

Anthony is admitted to practice in the courts of the State of New York, State of Connecticut as well as the United States District Courts for the Southern and Eastern Districts of New York.

 

Anthony serves as the co-chair of the Nassau County Bar's Construction Law Committee.  He has attained Super Lawyers recognition, a rating of outstanding lawyers from more than 70 practice areas who have attained a high degree of peer recognition and professional achievement in their practice area.
